In the recent literature a number of free will skeptics, skeptics who believe that punishment is justified only if deserved, have argued for these two points: first, that the free will realist who would justify punishment has the burden of establishing to a high level of certainty - perhaps beyond a reasonable doubt, but certainly at least by clear and convincing evidence - that any person to be punished acted freely in breaking the law; and, second, that that level of (...) evidence is simply not there. In this paper I make two parallel points against a quarantine theory of criminal justice. First, the free will skeptic who would justify universal criminal quarantine is also faced with a burden of proof, the burden to establish to a similarly high level that no human being ever acts freely. Second, there is not sufficient evidence for that conclusion either. I believe that the quandary that this creates for criminal justice can be resolved by distinguishing the methods associated with a particular approach from the approach itself: if our choice is between the methods of punishment and the methods of quarantine, the methods that constitute punishment are, I would argue, morally preferable to those that constitute quarantine. In this paper I propose a form of free will fallibilism. Unlike the free will realist who is fully persuaded that we have sufficient evidence of freedom to justify holding individuals morally responsible for what they do and imposing punishment, and unlike the free will skeptic who is fully persuaded that we do not have enough evidence to believe that we face a future of open alternatives, the free will fallibilist will believe that we have enough evidence to justify a (...) belief in freedom for some purposes but not for others. Along the way I argue that deliberation-compatibilism of the sort recently defended by Pereboom is subject to a very familiar sort of counterexample. The question that concerns me the most is whether punishment—this brutal institution that disposes of the lives of countless of our most vulnerable citizens—can be justified. I think it cannot, precisely because there is not sufficient evidence that human beings are free to choose between branching alternatives and so deserve to be treated like that. At least, if there is such justifying evidence it is more or less completely balanced by evidence that all events including human actions have causes. Moreover, I find compatibilism utterly unpersuasive. At the same time, I believe that I am a free agent; what I do is in large part up to me. I believe that the explanation of action cannot be reduced to causal explanation, and I believe that the logic of action requires a notion of branching time. I have two pictures of the universe; which of the two pictures I may rely upon will depend upon just what it is that I intend to do. Between the problem that preoccupies me, punishment, and my day-to-day choices, there is a wide gap. There are a lot of choices that, on the axis of justification, fall in between the two, many of them choices about how to treat those around us: whether to snub a friend who has insulted me, whether to castigate her, whether to reward a kind act with praise. Where to draw the line is a topic for another paper. The only principle that right now seems to me firm enough to act upon is this: the greater the likelihood of doing harm, the less likely the choice is to be justified. (shrink)

Challenging the public dichotomy characterizing fathers as “involved” or “absentee,” we investigate racial variation in college men’s perceptions of their paternal relationships and the gendered constructions these promote. The analysis draws on intensive interviews with Asian American, Black, and white sons from one university and survey data from 24 institutions. In both data sets, Asian Americans and Blacks describe greater paternal distance than do whites. This conceals variations in sons’ understanding of fathers. Asian Americans often criticize their fathers’ distance, disidentifying (...) with the near-exclusive focus on breadwinning they describe among fathers. In contrast, Blacks and whites normalize and identify with their dads. Blacks emphasize the “laid-back,” “cool” masculinity their dads impart, while whites often emphasize the independent masculinity based on mentorship and friendship their dads offer. Recasting sociological theories, we argue these differences emanate from divergent structural contexts, but more importantly, cultural conceptions of fatherhood, race, and gender as well as public discussions that valorize white models of fatherhood. The medieval fascination with the mysterious language of Dionysius the Areopagite is nowhere more evident than in the thirteenth-century textbook edition of his treatise on liturgical rites. Dionysius employed unfamiliar Greek to describe people, actions, and texts that would have been perfectly familiar to his readers. The Latin translation used in the thirteenth-century textbook strives to preserve this unfamiliarity, but commentaries are introduced between its lines and paragraphs, disrupting its ability to bewilder and surprise. These commentaries make the Dionysian text (...) less mysterious, while also slightly altering its meaning. In the hands of the commentators, Dionysius becomes less interested in the aesthetic mystery of the liturgy, and more interested in credal orthodoxy. To read text and commentary together is to confront seven hundred years of competing voices speaking on the nature and purpose of the Christian church. (shrink)

Seeing-as and Novelty brings together new essays that consider Wittgenstein’s treatment of the phenomenon of aspect perception in relation to the broader idea of conceptual novelty; that is, the acquisition or creation of new concepts, and the application of an acquired understanding in unfamiliar or novel situations. Over the last twenty years, aspect perception has received increasing philosophical attention, largely related to applying Wittgenstein’s remarks on the phenomena of seeing-as, found in Part II of Philosophical Investigations , to issues within (...) philosophical aesthetics. Seeing-as, however, has come to occupy a broader conceptual category, particularly in philosophy of mind and philosophical psychology. The essays in this volume examine the exegetical issues arising within Wittgenstein studies, while also considering the broader utility and implications of the phenomenon of seeing-as in the fields of aesthetics, philosophical psychology, and philosophy of mathematics, with a thematic focus on questions of novelty and creativity. Erwin Panofsky developed the postulate of clarification to explain the mental habit common to Gothic architecture and Western medieval scholasticism, but the postulate is equally applicable to the commentary tradition of Song-dynasty China. The commentary on the Book of Changes authored by Cheng Yi (1033–1107) provides a good example of how the Confucians of the Song dynasty took their concern for clarity to a recognizably medieval extreme. By looking at how Cheng Yi understands and foregrounds the clarity of the Book (...) of Changes, we can begin to see both what was medieval about Song-dynasty China and why the medieval method continues to be viable for interpreters of the Book of Changes. This article describes some potential uses of Bayesian estimation for time-series and panel data models by incorporating information from prior probabilities (i.e., priors) in addition to observed data. Drawing on econometrics and other literatures we illustrate the use of informative “shrinkage” or “small variance” priors (including so-called “Minnesota priors”) while extending prior work on the general cross-lagged panel model (GCLM). Using a panel dataset of national income and subjective well-being (SWB) we describe three key benefits of these priors. First, they (...) shrink parameter estimates toward zero or toward each other for time-varying parameters, which lends additional support for an income → SWB effect that is not supported with maximum likelihood (ML). This is useful because, second, these priors increase model parsimony and the stability of estimates (keeping them within more reasonable bounds) and thus improve out-of-sample predictions and interpretability, which means estimated effect should also be more trustworthy than under ML. Third, these priors allow estimating otherwise under-identified models under ML, allowing higher-order lagged effects and time-varying parameters that are otherwise impossible to estimate using observed data alone. In conclusion we note some of the responsibilities that come with the use of priors which, departing from typical commentaries on their scientific applications, we describe as involving reflection on how best to apply modeling tools to address matters of worldly concern. The luminaries of late thirteenth-century Europe took great interest in the mysterious fifth-century author known as Dionysius the Areopagite. They typically read Dionysius not in the original Greek, but in a Latin edition prepared sometime in the middle of the thirteenth century. This edition, which appeared first in Paris and later circulated all over Western Europe, was no mere translation. In addition to the famous translation made by Eriugena in the ninth century, it contained translations of scholia on the Dionysian (...) texts made by Anastasius the Librarian, alternative readings provided by Anastasius and other Latin readers, as well as excerpts from Eriugena's own theological masterwork, the Periphyseon. University scholars such as Albert the Great and Thomas Aquinas thus learned Dionysian mystical theology not only from his text, but from the seven-hundred year interpretive tradition that literally surrounded it on the page. The Song and Ming dynasty Confucians make frequent use of what would today be identified as a slippery slope argument. The Book of Changes and its early commentaries provide both the language and the rationale for this argument, inasmuch as the Confucians regard these texts as a method for identifying tiny problems that will one day threaten the state. While today the slippery slope argument is often criticized for promoting an unreasoned resistance to change, a close look at its use (...) by Confucians reveals that they largely avoid this criticism, using the argument in a reasoned way to target not change, but excess. The confirmatory nature of the empirical evidence used to establish UG effects in L2 development is considered. Specific issues are also raised concerning the internal validity of Epstein et al.'s findings. It is concluded that the role of UG in adult L2 development will only be established when researchers better understand the interaction between the development of UG-constrained structural knowledge and the development of overall L2 proficiency.

As the research integrity officer at my university for two years, I handled eight allegations of plagiarism. These eight cases show that initial appearances can be mistaken, that policies for handling allegations of research misconduct cannot cover every contingency, and that many cases can be resolved collegially without resort to formal procedures.
